Abstract

The obligation of seller's doesn’t expire with deliver، because of its followed by his guarantee obligation what is shown in the sale of a defect that diminishes the benefit that the buyer seeks to obtain، its mean that achieving his purpose of buying the sale or it may diminish the value of the sale. Therefore the buyer shall return to the seller under the pretext of ensuring the hidden defects organized by the legislator in the provisions of the Iraqi civil law.
