Abstract

AbstractThe sale is considered one of the contracts permitted in Islam and was established in accordance with the rules and principles, the seller and the buyer are the parties to the sale, and the ownership of the sale is not transferred from the seller to the buyer unless the seller is mature adult person, but despite this may get to sell the capable and incapable minor, insanity person, so selling it raises a problem in practice, the one who loses the thing does not give him, but the occurrence of such in our working life. The legislator was forced to regulate and restrict this process, and examine the minor with special provisions
